プライバシーポリシー

MSWWork（以下、「当方」といいます。）が提供するサービス（以下、「本サービス」といいます。）における、ユーザーの個人情報の取扱いについて、以下のとおりプライバシーポリシー（以下、「本ポリシー」といいます。）を定めます。

第1条（個人情報）

「個人情報」とは個人情報保護法にいう「個人情報」を指すものとし、生存する個人に関する情報であって、当該情報に含まれる氏名、生年月日、住所、電話番号、連絡先、その他の記述等により特定の個人を識別できる情報及び容貌、声紋にかかるデータなど特定の個人を識別できる情報（個人識別情報）を指します。

第2条（個人情報の収集方法）

当方は、ユーザーが本サービスの利用に際し氏名などの個人情報をお尋ねすることがあります。また、ユーザーと提携先などとの間でなされたユーザーの個人情報を含む取引記録や決済に関する情報を当方の提携先（情報提供元、広告主、広告配信先などを含みます。以下、「提携先」といいます。）などから収集することがあります。

第3条（個人情報を収集・利用する目的）

当方が個人情報・データを収集・利用する目的は以下のとおりです。

  • 本サービスの提供・運営・機能改善のため
  • AIを活用したフィードバック・分析等の機能を提供するため（外部AIサービスへのデータ送信を含みます。詳細は第6条をご確認ください。）
  • ユーザーからのお問い合わせに回答するため（本人確認を行うことを含む）
  • ユーザーが利用中のサービスの新機能、更新情報、キャンペーン等及び当方が提供する他のサービスの案内のメールを送付するため
  • メンテナンス、重要なお知らせなど必要に応じたご連絡のため
  • 利用規約に違反したユーザーや不正・不当な目的でサービスを利用しようとするユーザーの特定をしご利用をお断りするため
  • ユーザーにご自身の登録情報の閲覧や変更、削除、ご利用状況の閲覧を行っていただくため
  • 有料サービスにおいてユーザーに利用料金を請求するため
  • 上記の利用目的に付随する目的

第4条（利用目的の変更）

当方は、利用目的が変更前と関連性を有すると合理的に認められる場合に限り個人情報の利用目的を変更するものとします。利用目的の変更を行った場合には、変更後の目的について所定の方法によりユーザーに通知しまたは本ウェブサイト上に公表するものとします。

第5条（個人情報の第三者提供）

当方は、次に掲げる場合を除いてあらかじめユーザーの同意を得ることなく第三者に個人情報を提供することはありません。ただし個人情報保護法その他の法令で認められる場合を除きます。

  • 人の生命、身体または財産の保護のために必要がある場合であって本人の同意を得ることが困難であるとき
  • 公衆衛生の向上または児童の健全な育成の推進のために特に必要がある場合であって本人の同意を得ることが困難であるとき
  • 国の機関もしくは地方公共団体またはその委託を受けた者が法令の定める事務を遂行することに対して協力する必要がある場合であって本人の同意を得ることにより当該事務の遂行に支障を及ぼすおそれがあるとき
  • 予め次の事項を告知あるいは公表し、かつ個人情報保護委員会に届出をしたとき
    • 利用目的に第三者への提供を含むこと
    • 第三者に提供されるデータの項目
    • 第三者への提供の手段または方法
    • 本人の求めに応じて個人情報の第三者への提供を停止すること

前項の定めにかかわらず次に掲げる場合には当該情報の提供先は第三者に該当しないものとします。

  • 当方が利用目的の達成に必要な範囲内において個人情報の取扱いの全部または一部を委託する場合
  • 合併その他の事由による事業の承継に伴って個人情報が提供される場合
  • 個人情報を特定の者との間で共同して利用する場合であってその旨並びに共同して利用される個人情報の項目、共同して利用する者の範囲、利用する者の利用目的および当該個人情報の管理について責任を有する者の氏名または名称について、あらかじめ本人に通知し、または本人が容易に知り得る状態に置いた場合

第6条（外部AIサービスの利用）

本サービスでは、AI関連機能を提供するために、外部のAIサービスを利用しています。当該機能の利用に際して、以下のとおりユーザーのデータを外部AIサービスに送信します。

1. 送信されるデータ

  • ユーザーが入力または発話したテキスト・音声データ

2. 送信先

以下の事業者が提供するAIサービス（以下、総称して「外部AIサービス」といいます。）を利用する場合があります。

  • Google LLC
  • OpenAI, Inc.
  • Anthropic, PBC

3. 利用目的

送信されたデータは、AI による分析およびフィードバックの生成にのみ使用されます。

4. データの取扱い

  • 送信されたデータは、外部AIサービスのAPI を通じて処理され、回答の生成後は外部AIサービス提供元のデータ保持ポリシーに従って取り扱われます。
  • 当方は、外部AIサービスの利用にあたり、ユーザーのデータが適切に保護されるよう、外部AIサービス提供元のセキュリティ基準およびプライバシーポリシーを確認しています。

5. ユーザーの同意

AI関連機能の初回利用時に、上記のデータ送信について同意を求めます。ユーザーが同意しない場合、AI関連機能はご利用いただけませんが、その他の機能は引き続きご利用いただけます。

第7条（プライバシーポリシーの変更）

本ポリシーの内容は、法令その他本ポリシーに別段の定めのある事項を除いて、ユーザーに通知することなく変更することができるものとします。重要な変更の場合には、本サービス上であらためて通知し、利用者の同意を取得します。

Privacy Policy

This Privacy Policy (the "Policy") sets forth how MSWWork ("we", "us", or "our") handles users' personal information in connection with the services we provide (the "Service").

Article 1 (Personal Information)

"Personal information" refers to information about a living individual that can identify the specific individual by name, date of birth, address, telephone number, contact information, or other descriptions, as well as data such as facial features and voiceprints that can identify a specific individual.

Article 2 (How We Collect Personal Information)

We may ask users for personal information such as their name when using the Service. We may also collect information including transaction records and payment information that contain users' personal information from our partners (including information providers, advertisers, and ad distributors; hereinafter "Partners").

Article 3 (Purpose of Collecting and Using Personal Information)

We collect and use personal information and data for the following purposes:

  • To provide, operate, and improve the Service
  • To provide AI-powered feedback and analysis features (including transmission of data to third-party AI services; see Article 6 for details)
  • To respond to user inquiries (including identity verification)
  • To send emails regarding new features, updates, campaigns, and other services we offer
  • To contact users as needed for maintenance and important notices
  • To identify users who violate the Terms of Service or attempt to use the Service for fraudulent or improper purposes, and to refuse their use
  • To allow users to view, change, or delete their registration information and view their usage status
  • To charge users for paid services
  • For purposes incidental to the above

Article 4 (Changes to Purpose of Use)

We will only change the purpose of use of personal information when it is reasonably related to the original purpose. When the purpose of use is changed, we will notify users or publish the revised purpose on our website.

Article 5 (Disclosure of Personal Information to Third Parties)

We will not provide personal information to third parties without the prior consent of the user, except in the following cases and where permitted by applicable laws:

  • When necessary to protect a person's life, body, or property and it is difficult to obtain consent
  • When especially necessary for improving public health or promoting the sound development of children and it is difficult to obtain consent
  • When it is necessary to cooperate with a national or local government body or their agent in performing duties prescribed by law, and obtaining consent may impede such duties
  • When the following items have been announced or published in advance and reported to the Personal Information Protection Commission:
    • That the purpose of use includes provision to third parties
    • The items of data provided to third parties
    • The means or method of provision to third parties
    • That provision to third parties will be stopped at the request of the individual

Notwithstanding the foregoing, the recipients in the following cases shall not be considered third parties:

  • When we outsource all or part of the handling of personal information to the extent necessary to achieve the purpose of use
  • When personal information is provided as a result of business succession due to a merger or other reason
  • When personal information is used jointly with a specific party, and the individual has been notified in advance or can easily access information about the items of data shared, the scope of parties sharing the data, the purpose of use, and the person responsible for managing the data

Article 6 (Use of Third-Party AI Services)

The Service uses third-party AI services to provide AI-related features. When using these features, user data is transmitted to third-party AI services as described below.

1. Data Transmitted

  • Text and voice data entered or spoken by the user

2. Recipients

We may use AI services provided by the following companies (collectively, the "Third-Party AI Services"):

  • Google LLC
  • OpenAI, Inc.
  • Anthropic, PBC

3. Purpose of Use

Transmitted data is used solely for AI-powered analysis and generation of feedback.

4. Data Handling

  • Transmitted data is processed through the Third-Party AI Services' APIs, and after response generation, is handled in accordance with each provider's data retention policies.
  • We have reviewed the security standards and privacy policies of the Third-Party AI Service providers to ensure that user data is appropriately protected.

5. User Consent

We will request your consent to the above data transmission before you first use any AI-related features. If you do not consent, AI-related features will not be available, but you may continue to use other features of the Service.

Article 7 (Changes to This Privacy Policy)

We may change the contents of this Policy without prior notice to users, except as otherwise provided by law or in this Policy. In the case of significant changes, we will notify users through the Service and obtain their consent.
